1. Acceptance of these terms
This website is operated in connection with The Evolution of Korea, a documentary production (“we”, “us”, “our”). By accessing or using this website you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the site. If you use the site on behalf of an organization, you represent that you are authorized to bind that organization to these terms.
2. Purpose of this website
This website is provided for general information about the documentary and to allow interested people to follow the production and to make underwriting or sponsorship inquiries. Nothing here is professional, historical, legal, financial or investment advice, and nothing here should be relied upon as a statement of historical fact for academic or professional purposes.
3. Production status and forward-looking statements
The film is in production. Statements on this site about production schedules, completion dates, distribution, broadcast, language versions or participation by any individual or institution are forward-looking statements of present intention. They are not promises or guarantees. Documentary production depends on funding, rights clearances, scheduling, editorial judgement and the decisions of broadcasters and distributors, and any of these may change.
We may change, delay, suspend or abandon any aspect of the production, and we may amend or remove any statement on this site, at any time and without notice. No statement on this site creates any obligation on us to complete the film, to complete it by any date, to distribute or broadcast it, or to include any particular content or participant.
4. Intellectual property
The name “The Evolution of Korea”, the logo, the design, layout, text, graphics and compilation of this website, and the film and all footage, scripts and materials relating to it, are owned by us or by our licensors and are protected by copyright, trademark and other intellectual property law. All rights are reserved except as expressly granted in these terms.
5. Archival material and third-party rights
This website reproduces archival photographs and other historical materials. Some of these are owned by third parties and are used with permission or under licence, and some are the subject of ongoing rights clearance. Nothing on this site transfers any right in that material to you. You may not copy, download, reproduce, distribute or reuse any photograph or archival material from this site for any purpose without written permission from us and, where applicable, from the rights holder.
We aim for accuracy in describing historical material. If you believe any image, caption or description on this site is inaccurate, or that material has been used without proper authorization, please contact us and we will review it promptly.
6. Permitted use and restrictions
You may view this website and print or download individual pages for your own personal, non-commercial reference. You may link to the home page. You may not:
- copy, republish, sell, licence or commercially exploit any part of the site;
- use any text, photograph, logo or design element in any other work or website;
- frame the site or present it as your own, or use our name or logo without permission;
- use automated means to scrape, harvest or index the site other than ordinary search engine indexing;
- attempt to gain unauthorized access to the site or any related system, or interfere with its operation;
- submit anything unlawful, defamatory, infringing, misleading, or containing malicious code;
- use contact details published on this site to send unsolicited commercial communications.
7. Your submissions
When you submit information through a form on this site, you confirm that it is accurate and that you are entitled to provide it. If you provide another person’s details, you confirm you have their permission. We handle what you submit in accordance with our Privacy Policy.
8. Unsolicited ideas and materials
We do not accept unsolicited creative submissions — story ideas, treatments, scripts, footage, photographs, music or similar material. If you send them anyway, you agree that they are submitted without any obligation of confidentiality on our part, that we owe you no compensation, and that we may already be developing or may in future develop material that is similar or identical. This clause protects both of us: documentary productions frequently receive similar suggestions independently, and we cannot review unsolicited material without creating exactly the kind of dispute this paragraph is intended to avoid.
If you hold archival material you believe is relevant to the film and wish to discuss licensing it, please write to us first and describe it in general terms without sending the material itself.
9. Sponsorship inquiries are not an offer
Information on this site about underwriting and sponsorship is an invitation to begin a conversation. It is not an offer, and submitting an inquiry does not create any agreement, any entitlement to a credit or acknowledgement, or any obligation on either of us. Any sponsorship or underwriting arrangement will be set out in a separate written agreement signed by both parties.
Underwriting credits on public television are governed by regulation and by the policies of the stations and networks that carry a programme. Nothing on this site promises any particular credit, placement, wording, airtime, promotional benefit or audience.
Nothing on this site is an offer to sell or a solicitation of an offer to buy any security or investment interest of any kind.
10. Email communications
If you subscribe to production updates you consent to receive periodic email from us about the film. Every message contains a one-click unsubscribe link, and we will stop sending as soon as you use it. We do not sell or rent our email list.
11. Third-party links
This site may link to websites we do not control. We provide those links for convenience only. We do not endorse and are not responsible for the content, accuracy, products, services or privacy practices of any third-party site. Following an external link is at your own risk.
12. Advisors and contributors
Biographies of the production team and advisors are published with their permission and describe their professional background. The institutions named in those biographies — including government agencies, armed services, universities and research organizations — are identified for identification purposes only. Their appearance on this site does not imply that any institution endorses, sponsors, has commissioned, or is affiliated with the film, and it does not imply that any advisor is speaking for their institution.
13. Disclaimer of warranties
This website is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free, that defects will be corrected, or that the site or the server that makes it available is free of harmful components. We make no warranty as to the accuracy, completeness or currency of any content.
14. Limitation of liability
To the fullest extent permitted by law, we and our producers, directors, employees, contractors and advisors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of or inability to use this website, whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to this website will not exceed one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions our liability is limited to the greatest extent permitted by law, and nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded.
15. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, liability or expense — including reasonable legal fees — arising out of your use of this website, your breach of these terms, or your violation of any law or the rights of any third party.
16. Governing law and disputes
These terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in Skagit County, Washington will have exclusive jurisdiction over any dispute arising out of or relating to these terms or this website, and you consent to the personal jurisdiction of those courts.
If you access this site from outside the United States, you do so on your own initiative and are responsible for compliance with local law. Nothing in this section deprives a consumer of the protection of mandatory law in their country of residence.
Any claim must be brought within one year after it arises, to the extent permitted by law.
17. General
- Changes. We may amend these terms at any time by posting a revised version here with a new “last updated” date. Continued use after that date means you accept the change.
- Severability. If any provision is held unenforceable, the remainder stays in full force and the unenforceable provision is modified to the minimum extent necessary.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Entire agreement. These terms and the Privacy Policy are the entire agreement between you and us regarding this website.
- Assignment. You may not assign these terms. We may assign them in connection with a transfer of the production.
